当前主流的职业伤害赔偿模式中,最具代表性的是替代模式和补充模式。替代模式的优点是劳动者可以及时获得经济救助,雇主可以提前规划用工成本,社会能够节约诉讼等成本,但其难以实现对劳动者的完全经济补偿;补充模式的优点是劳动者既能获得及时救助,也有望取得全部经济补偿,但司法成本更高,社会管理职能缺位。我国应在充分考虑本国社会文化特点、经济发展状况和现有法律体系的情况下,建立完善具有中国特色的职业伤害赔偿体系。这套体系可以参考并兼具德国模式人性化的特色和美国模式市场化的优点,建设有中国特色的替代模式,即由政府和私人保险公司共同经营职业伤害赔偿体系。
