纪律处分是否应该进入司法审查视野取决于学校纪律处分的性质。由于我国研究教育法学的学者忽视了学校教育管理权的来源,造成了对学校纪律处分性质在认识上的混乱,从理论上澄清学校教育管理权的来源,达到确认高校纪律处分性质的目的,可以疏通学生因纪律处分引发的受教育权争议的诉讼渠道,解决司法实践上的理论困境。
Whether disciplinary action should enter the horizons of judicial review depends on the nature of school disciplinary action. As scholars in China’s law of education and study neglect the source of the right to administer the school education and cause confusion on the nature of the disciplinary nature of the school, it is theoretically possible to clarify the source of the right to administer the school education and achieve the purpose of confirming the disciplinary nature of the university. Dispel the lawsuit channels that the students dispute over the right to education due to disciplinary action and solve the theoretical predicament in judicial practice.
