要实现创新驱动发展,需要吸引创新要素投入到创新中去。在这些创新要素中,人是科技创新的最关键因素。只有不断完善职务发明法律制度,保障职务发明人的合法权益,才能使科研人员的创新价值得到尊重,才能激励其创新积极性并为创新驱动发展提供原动力。本文首先分析了目前中国的法律制度和实际经验中职务发明归属的相关问题,同时比较了世界主要的几个国家关于职务发明归属的规定,从最近公布的《专利法修改草案》和《职务发明条例草案》中引入的“发明报告制度”和再次重申的“约定优先制度”入手,对我国职务发明的归属问题进行了分析。
In order to achieve innovation-driven development, we need to attract innovative elements into innovation. Among these innovations, people are the most crucial factor in technological innovation. Only by constantly improving the legal system of service invention and safeguarding the legitimate rights and interests of service inventors can the innovative value of the researchers be respected, in order to stimulate their innovative enthusiasm and provide impetus for innovation-driven development. This article first analyzes the current legal system and practical experience in China’s ownership of job-related issues, at the same time compared the major countries in the world on the provisions of the ownership of the invention, from the recently published “Draft Patent Law” and “service invention Bill of Rights ”introduced in the“ invention report system ”and reiterated “ agreed priority system ”to start, the ownership of the invention of our country were analyzed.
