长沙市中院“曾成杰案”微博事件和北卡罗莱纳州法官T脸书事件向法官敲响了慎重使用社交网络的警钟,同时也表明我国应当对法官使用社交网络规制的问题予以重视。法官使用社交网络可能引发以下问题:一是传统法官职业伦理的实际约束力降低;二是社交网络环境下法官不当行为的破坏力扩大;三是引发了传统法官职业伦理规制“盲区”的出现。美国各州最先洞察了法官使用社交网络存在的危机,并制定了相应的规范。为了避免法官使用社交网络所带来的危机,我国有必要对法官使用社交网络的行为予以规制。
