近年来,银行承兑汇票作为信用工具,在商品购销中使用越来越受到企事业单位的欢迎。作为银行承兑汇票持票人的企事业单位,由于种种原因未能在法定的提示付款期内提示付款,以致有的承兑银行想方设法拒绝承兑,给持票人带来不应有的伤害。若发生这种情况,持票人应如何实现票据权利呢? 1.持票人要立即与开户银行联系,取得开户银行的理解和帮助。中国人民银行《支付结算办法》第八十八条规定:“持票人超过提示付款期提示付款的,持票人开户银行不予受理。”因此持票人要及时地与开户银行沟通,出具延误理由说明,争取开户银行受理,请求承兑银行付款业务。 2.通过开户银行办理委托收款方式(要附带有关理由说明),请求承兑银行付款。《票据法》第五十三条规定:“持票人未按照规定期限提示付款的,在
