目前我国关于政府信息公开案件日益增加,其中对于有关过程性信息的公开申请比重也不断上升,但是目前对于过程性信息的认定存在争议,使公民在申请信息公开时合法权益得不到应有的保障。我国的《政府信息公开条例》尚未将过程性信息纳入到不公开的范围中,本文认为在今后的立法修订中应当以最大限度地保障我国公民的知情权为主要原则,遵循“公开为常态,不公开为例外”的基本要求,将需要免于公开的过程性信息的相关规定在立法上加以明确,使其在实践中得到正确的适用。
At present, there are more and more public cases of government information disclosure in our country, of which the proportion of open applications for process information is also on the rise. However, there is controversy over the identification of process information so that citizens’ legitimate rights and interests can not be obtained when the application for information disclosure Protection. In our country, the “Government Information Disclosure Ordinance” has not incorporated the procedural information into the unpublished scope. This paper argues that in the future legislative amendments, the principle of maximizing the right to information of our citizens should be adhered to and the principle of “ , Not open as an exception ”the basic requirements, will need to be exempt from the public process of information relevant provisions in the legislation to be clear, so that it is correctly applied in practice.
