本文以美国电视剧《波士顿法律》中的五场经典民事审判视频录音的转写语料为基础,从话语分析这一视角,对庭审互动中话语打断现象的具体表现进行探讨。由于在庭审“问-答”互动中,参与者会不自觉地保持距离感,在潜意识中具有权力角色定位,继而形成了以法官、律师为代表的话语强势方和以原告、被告、证人为主的话语弱势方。前者可依职权或利益通过不同的打断模式控制后者的话轮,进而影响司法的公正性;但后者亦可运用打断模式进行反控制与反干预。因此,本文拟为庭审参与者提供相应的应对策略,以期对法律工作者的出庭能力和审判质量的提高有一定启示。
Based on the corpus of five classical civil trial video recordings in the American TV series “Boston Law,” this article explores the concrete manifestation of discourse interruption in courtroom interaction from the perspective of discourse analysis. Because of the interaction between court trial and question-answer, participants unconsciously maintain a sense of distance and subconsciously have the role of power. In turn, they form a powerful party with judges and lawyers as their representative and the plaintiffs, defendants, Witness the main discourse weak party. The former can control the latter by different modes of disruption according to its own authority or interests, thereby affecting the impartiality of the judiciary. However, the latter can also use the disruptive mode to exercise anti-control and anti-interference. Therefore, this article intends to provide corresponding coping strategies for trial participants in the hope of enlightening the appearance of legal practitioners and improving the quality of trial.
