以正义为名,将法律看作是可废止的,是要在司法裁判中恢复法律作为道德事业的本来面目。这要求我们尽可能地在法律的弹性空间内将道德考量纳入其中:而在合法性空间用尽时,审慎考虑在当前个案中引入法外因素废止可适用的法律规范。无论如何,在援引法外因素时,裁判者都需要给出妥当的论证,作出废止决定者更是要承担更高的论证责任。现代法律体系为这种可废止法的运行提供了可用的轨道。
In the name of justice, the law can be regarded as abolished, is to restore law in judicial decisions as the true face of ethical undertakings. This requires us to include ethical considerations as much as possible within the elastic space of law: when the space for legitimacy is exhausted, careful consideration is given to introducing extra-legal factors into current cases to repeal applicable legal norms. In any case, when invoking extrajudicial factors, the referees need to give proper arguments and those who make the abolition decision even have to assume a higher burden of argument. The modern legal system provides a usable track for the operation of this repeallable law.
