三阶层理论和四要素说之争由来已久,由于我国现行刑法通用四要素说,长久以来忽略了三阶层理论的优先性,相当部分的学者认为三阶层理论是资本主义的论调,不适合社会主义国家,这是政治意识形态下的偏见。相对于四要素说在人权保障、司法独立方面的无力与缺陷,三阶层理论都体现出了值得借鉴的优先性。
The debate between the theory of the third strata and the four elements has been onerous for a long time. Since the four elements of the current general criminal law in our country have long neglected the priority of the theory of the third strata, a considerable number of scholars think that the theory of the third strata is an argument of capitalism and not suitable for the society This is a prejudice under the political ideology. Compared with the four elements, the weaknesses and defects in the protection of human rights and the independence of the judiciary all reflect the priorities worth learning from.
