在劳动法中,劳动者相对应的概念是用工者,但是这一概念本身比较复杂,所以关于劳动法上用人单位的概念界定目前没有明确的统一的认定。但是在域外立法中根据劳动者的界定对用人单位进行法律推定,司法机关在处理案件时也可以根据具体的情况认定用人单位。用人单位这个概念关系着劳动关系和劳动法学理论的研究,也关系着劳动法的发展和社会改革变迁。对用人单位的界定,还对劳动法律关系的本质理解和相关的立法实践也具有一定的意义。
In the labor law, workers correspond to the concept of workers, but the concept itself is more complex, so there is no clear and unified definition of the concept of employing units in labor law. However, in extraterritorial legislation, according to the definition of laborers, the employer is presumptively legalized, and the judiciary may also identify the employing unit according to the specific circumstances when handling the case. The concept of employer is related to the study of labor relations and labor law theory, and is also related to the development of labor law and changes in social reform.
