做为政治哲学家的汉娜·阿伦特虽无一本著作专门阐述法律,但对法律的思考贯穿于一生之中。她认为政治的本质乃是复数的人在公共空间内参与共享和讨论的实践。她对劳动和制作的联系、对行动的重视以及权力与暴力等概念的理解,不可避免影响到其对法律的理解。她从一个崭新的政治视野去看待法律,包括对宪法和法律起源的独特见解,对极权主义、人权法律的思考,对国际刑法理论的贡献,对法国大革命和美国独立运动的研究等等。
Although Hannah Arendt, a political philosopher, does not have a single book devoted to the law, his thinking on the law runs through his life. She believes that the nature of politics is the practice of plural people participating in sharing and discussion in the public space. Her understanding of the links between labor and production, the emphasis on action and the concepts of power and violence inevitably affect her understanding of the law. She looked at the law from a brand new political perspective, including unique insights into the origins of the constitution and law, her thoughts on totalitarian law and human rights law, her contribution to international criminal law theory, her study of the French Revolution and the American Independence Movement.
