《中华人民共和国招标投标法》颁布后对招投标活动的交易双方和相关责任人的行为进行了规范,其中在第四十一条中对中标人的投标提出明确规定,应当符合下列条件之一:(一)能够最大限度地满足招标文件中规定的各项综合评价标准;(二)能够满足招标文件的实质性要求,并且经评审的投标价格最低;但是投标价格低于成本的除外。这实际上涉及到两种不同的评标办法,前一种是综合因素评标,后一种是满足招标文件实质性要求的最低价中标(单因素)。特别是后一种方法更接近国际惯例,使我国的招投标活动能进一步与国际接轨。工程建设招标活动中采用“最低价中标”方式,淡化了标底的作用,避免许多定性评价因素的作用,降低了其中人为因素影响和碰运气
After the promulgation of the “Bidding and Bidding Law of the People’s Republic of China”, the behaviors of both the parties to the bidding and bidding activities and the responsible persons are regulated. Among them, the explicit stipulation of the bidding of the successful bidder in Article 41 shall meet one of the following conditions (1) Being able to meet the comprehensive evaluation criteria stipulated in the bidding documents to the maximum extent; (2) Being able to meet the substantive requirements of the bid invitation documents and having the lowest bidding price under review; except that the bidding price is lower than the cost. This actually involves two different methods of bid evaluation, the former is the comprehensive evaluation of the tender, the latter is to meet the substantive requirements of the tender documents the lowest bid (single factor). In particular, the latter approach is closer to international practice, enabling China’s bidding and bidding activities to further integrate with the international community. Adopting “lowest bidding ” method in project construction bidding activities, played down the role of bidding base, avoided the role of many qualitative appraisal factors, reduced the impact of human factors and luck
