作为信息传播的媒介,互联网的出现改变了人们交流沟通的方式,也日益成为专利审查工作的一项极为重要的检索资源,这促使人们对现有技术的内涵产生了新的理解。互联网信息的不稳定性和多样性无疑给专利法的适用带来了一定的困惑,如何在现有法律框架下将互联网信息纳入现有技术的范围存有诸多困难。新修订的专利法对新颖性和现有技术进行了重新定义,这给处于尴尬境地的互联网信息的可专利性提供了某种含糊的解决进路。为此,有必要进一步明确互联网信息的法律地位并对出现的诸实证问题进行研究,以期实现激励创新与保护社会公共利益上的平衡。
As a media for information dissemination, the advent of the Internet has changed the way people communicate and become increasingly important sources of search resources for patent prosecution, prompting a new understanding of the connotation of existing technologies. The instability and diversity of internet information undoubtedly bring some confusion to the application of the patent law. There are many difficulties in how to integrate Internet information into the existing technology within the existing legal framework. The newly revised patent law redefined the novelty and the prior art, providing a somewhat vague solution to the patentability of Internet information in an awkward position. To this end, it is necessary to further clarify the legal status of Internet information and to study the empirical issues that arise, with a view to achieving a balance between stimulating innovation and protecting social public interests.
