劳务派遣概述劳务派遣亦称人力资源派遣、人才派遣和人才(员工)租赁,是近年我国人才市场根据市场需求而开办的新的人才中介服务项目,是一种新型的用人机制,可跨地区、跨行业进行。它源于20世纪70年代的美国。目前在美国、日本等发达国家已相当普及,用人单位可以根据自身工作和发展需要,通过劳动行政部门批准成立的正规劳务服务公司,派遣所需要的各类人员。实行劳务派遣后,实际用人单位与劳务派遣组织(劳务服务公司)签订《劳务派遣合同》,劳务派遣组织与劳务人员(劳动者)签订《劳动合同》;实际用人单位与劳务人员签订《服务协议》,双方之间只有劳务关系,即使用关系,没有劳动关系。云南电网公司于2002年在农村电工中推行了劳务派遣制。
