当前,我国法学专业高等教育体系中的模拟审判实践教学“表演性”成分过度,仿真性程度不足。此种教学效果不利于学生综合实践能力、独立思考与决断能力的培养,同时也模糊了模拟审判个体角色责任范围的界线。造成这种教学效果的原因是多方面的。我国各高校法学院系教学管理部门应提高对模拟审判教学仿真性程度的关注度、应建立模拟审判仿真性程度考核的明确标准,同时,应打破模拟审判人员组成上的传统的班级成员组合模式,以此来降低模拟审判教学的“表演性”成分,增强其仿真性比例。
At present, the simulated trial practice teaching in the higher education system of law major in our country is overcompensated and the simulation degree is not enough. This kind of teaching effect is not conducive to students’ comprehensive practical ability, independent thinking and decision-making ability, but also obscures the boundary line of the scope of responsibility of individual judges. The reasons for this teaching effect are many. Teaching management departments of law schools in all universities in our country should pay more attention to the simulation degree of simulation teaching and should set up a clear standard to simulate the degree of simulation. At the same time, the traditional composition of class members should be broken , In order to reduce the “performance ” component of the mock trial teaching, to enhance its simulation ratio.
