20世纪 60年代末到 80年代中期 ,美国联邦政府先后出台 17部信用法律 ,从《公平信用法》到《信用修复机构法》 ,形成了一个完备、系统的法律体系。而我国的信用体系建设尚处于初始阶段 ,信用法律更滞后于信用体系的发展 ,内容上极不完整 ,结构上有很大欠缺 ,严重制约着我国信用体系的健全和完善。本文借鉴美国信用法律体系的特点 ,并吸取其他发展中国家信用体系建设的经验 ,指出 ,我国信用法律体系建设应从信用基本法、专门法和相关法律规范三方面入手 ,逐步使之健全和完善
From the late 1960s to the mid 1980s, the federal government of the United States issued 17 credit laws successively, forming a complete and systematic legal system from the “Fair Credit Law” to the “Credit Repair Agency Law.” However, the credit system construction in our country is still in the initial stage. The credit law is lagging behind the development of the credit system. Its content is very incomplete and its structure is greatly lacking, seriously restricting the sound and perfect credit system in our country. This article draws lessons from the characteristics of the credit law system in the United States and draws lessons from the credit system construction in other developing countries. It points out that the construction of China’s credit law system should start from three aspects: the basic credit law, the special law and the relevant legal norms, and gradually improve and perfect it
