行政规范性文件在我国行政法治实践中的作用不容忽视,从程序上控制其违法性已成为学界共识。行政规范性文件制定程序的公众参与为研究对象,明确提出了界定公众的三个原则,即利益相关原则、机会均等原则、特殊平衡原则。这就要求在参与的制度设计方面应该重视公告制度、征求公众意见制度以及听证会制度,以充分发挥程序设计的法律效能。
The role of administrative normative documents in the practice of administrative law in our country can not be ignored. It has become the academic consensus to control their illegalities from a procedural point of view. Public participation in the administrative normative document development process as the research object, clearly put forward three principles of defining the public, namely the principle of benefit, the principle of equal opportunity and the principle of special balance. This requires that the public participation system, the public opinion system and the hearing system should be emphasized in the design of the system involved in order to give full play to the legal effectiveness of programming.
