《劳动合同法》自2007年6月29日颁布到2008年1月1日实施,在这期间,企事业单位必须要修订自己的规章制度和劳动合同。因为立法要解决劳动关系中的一些问题,法律就会为它增加很多以前没有的条文。原来认为合法的现在就违法了,比如不受工作年限的到期解除、终止合同不付经济补偿金以及未经培训就约定违约金条款等,这些都不可能了。这样,我们就对企事业单位的用人制度提出了一些自己的看法和观点,加强和完善企事业单位的人事管理制度。
The Labor Contract Law was promulgated on June 29, 2007 and implemented on January 1, 2008. During this period, enterprises and public institutions must amend their own rules and regulations and labor contracts. Because the legislature wants to solve some problems in labor relations, the law will add a lot of provisions that it did not have before. It turned out to be illegal now. For example, it is impossible to get rid of the expiration of working life, terminate the contract without financial compensation, and negotiate the liquidated damages clause without training. In this way, we put forward some views and opinions on the employment system of enterprises and institutions, and strengthen and improve the personnel management system of enterprises and institutions.
