引言知识产权是一把双刃剑,它既可以为企业保驾护航,也会给企业带来毁灭性的打击。一个商标关系到一个企业的兴衰成败。广药集团与香港鸿道集团(加多宝母公司)的“王老吉”商标之争历经数年,因商标价值逾千亿元人民币而被称为“中国第一商标案”。“王老吉”案的争议焦点值得我们对商誉权利与注册商标权利之间的法律关系的深思。中国凉茶领导品牌之争,掀起了社会舆论的轩然大波,更引起了法学界对合理保护商标许可中增值利益分配问题的广泛探讨。
INTRODUCTION Intellectual property is a double-edged sword, it can both escort the enterprise, but also to businesses devastating blow. A trademark relates to the success or failure of a business. After several years of dispute over “Wanglaoji” trademark between GPHL and Hong Kong Hongda Group (plus JDB), it was named “China’s No.1 Trademark Case” because the trademark value exceeded RMB100 billion. “Wang Lao Ji ” case the focus of controversy worth our consideration of the legal relationship between goodwill rights and registered trademark rights. The controversy over the leadership brand of Chinese herbal tea set off an uproar in public opinion and caused a wide range of discussions on the distribution of value-added benefits in the legal protection of trademark.
