《仲裁法》创设了仲裁这种不同于审判制度的纠纷解决机制,虽然仲裁制度没有《宪法》依据,但是《仲裁法》的制定没有超出全国人大常委会的职权范围且未违反《宪法》确立的国家权力分工原则,具有合宪性。通过对劳动争议仲裁与仲裁制度的对比分析不难发现:劳动争议仲裁不具备当事人的意思自治性和仲裁机构的非国家性的特征,因此,劳动争议仲裁不属于仲裁制度的范畴;鉴于劳动争议仲裁委员会实质上是披着华丽的“三方机制”外衣、由行政机关占主导、不能独立于行政机关的机构,《劳动争议调解仲裁法》所确立的由劳动争议仲裁委员会对劳动争议案件管辖并作出裁决的制度违反了宪法所确立的国家权力分工原则而违宪。
