明治维新初期日本在移植欧洲法制的同时,也继受罗马法(学)。日本的罗马法继受分为罗马法学继受和罗马法继受。罗马法学继受是以围绕着大学的罗马法教育和研究而展开的。罗马法继受是围绕着日本民法典的制定和“法典论争”而展开的,日本民法典间接继受罗马法。日本在继受罗马法(学)过程中产生了众多的罗马法大家和优秀的科研成果。日本罗马法研究经历了从私法到公法,从教授讲义到原典研究直至问题研究等的发展过程。参与罗马法研究的大家包括了民法学家、法史学家和比较法学家等法学大家。日本的罗马法研究引发的罗马法研究中心问题、罗马法继受方式问题和罗马法研究范围和方法问题等的思考,对中国的罗马法研究具有启示作用和借鉴意义。
In the early Meiji Restoration, Japan also inherited Roman law (learning) while transplanting the European legal system. The Roman law of Japan is divided into inheritance of Roman law and inheritance of Roman law. Roman jurisprudence is carried out around the university’s Roman law education and research. The succession of Roman law revolves around the formulation of the Japanese Civil Code and the “Code Debate.” The Japanese Civil Code indirectly inherited the Roman law. In the process of following the Roman law (learning), Japan has produced numerous Roman law and outstanding scientific research achievements. The study of Roman law in Japan has gone through the process of development from private law to public law, from lectures by professors to studies on the original canon until the question was studied. Everyone involved in the study of Roman law included civil law scholars, legal historians and comparative lawyers and other law scholars. The research on Roman Law initiated by the study of Roman Law in Japan, the method of inheritance of Roman Law and the scope and method of study of Roman Law are of enlightenment and reference significance for the study of Roman law in China.
