目前,很多企业在处理工伤待遇问题时,都采取一次性处理的方式,尤其在私营企业、镇村企业和个体经济组织中这种情况更为普遍。某市劳动争议仲裁委员会1999年处理的38起个体私营和镇村企业的工伤待遇争议案件中,双方或一方当事人要求一次性处理的占百分之百,并有34起最终实行了一次性处理、工伤待遇一次性处理尽管非常普遍,但对其合法性,以及什么情况下可以一次性处理,什么情况下不能一次性处理,很多企业和职工以及社会上存在模糊认识,有些将其与工伤私了混为一谈,甚至认为工伤待遇一次性处理是违法的。根据我国有关法律法规和政策规定,工伤待遇一次性处理违法与否,不能一概而论。在有些情况下,工伤待遇一次性处理是允许
